Business Disputes

SC BUSINESS LITIGATION ATTORNEYS FOCUSED ON RESULTS

Cost-effective, efficient representation for resolving complex disputes

Since 1984, attorneys at Lewis Babcock have been helping clients resolve business disputes throughout South Carolina. Our client-centered focus and robust legal representation consistently delivers results through negotiation, arbitration, mediation, or litigation in state and federal courts.  Each business dispute is as different as each client’s goals and resources. Our attorneys will work with you to find an approach to our services that meets your needs, whether that is hourly, contingency, or a blend of the two.

Our business litigation attorneys handle a wide variety of business and commercial cases, including conflicts arising from:
  • Breach of contract
  • Breach of fiduciary duty
  • Contractual interference
  • Corporate governance
  • Fraudulent business practices
  • Intentional damage to a business relationship
  • Negligent misrepresentation
  • Noncompete or nonsolicitation agreements
  • Officer and director wrongdoing
  • Ownership and partnership disputes
  • Unfair and deceptive trade practices
Business Litigation
In many instances, it can be advantageous to resolve the parties’ dispute through a negotiated settlement. When this isn’t possible, our experienced business litigators vigorously represent our clients’ interests in court.  Our approach enables us to manage complex litigation in a cost-effective manner, saving our clients time, frustration and money.

Government Disputes

Our litigation team has extensive experience representing businesses and landowners in disputes with the government.  From zoning changes that diminish property values to contract disputes, Lewis Babcock can protect your interests when state or local governments and related agencies take actions harmful to your property or business.

Experienced business litigators represent various stakeholders

Lewis Babcock attorneys litigate business disputes from a variety of perspectives on behalf of different stakeholders. Their individual experiences enable our attorneys to understand our clients’ interests as well as those of the adverse parties and to find creative solutions to seemingly insurmountable conflicts.

Clients we serve include:
  • Business owners — We help to resolve partnership disputes, shareholder disputes, and other controversies that bring into question the good faith or competence of owners and managers. Many actions involve the enforcement of partnership agreements or allegations of shareholder oppression following attempts to “squeeze out” or “freeze out” minority owners.
  • Startups, small businesses and corporations — Our attorneys represent plaintiff and defendant businesses in disputes over deceptive or unfair trade practices, theft of trade secrets, and breaches of contract. We also represent businesses in commercial landlord-tenant disputes and other real estate litigation issues.
  • Individuals and consumers — Our firm represents consumers in disputes with various businesses, including contractors, lenders and insurance companies. We assist homeowners, home owners associations, and other policyholders in disputes over insurance coverage and allegations of insurance bad faith or insurance fraud.
  • Class Actions – We also pursue class actions on behalf of plaintiffs that have been similarly harmed.  Ariail King assisted founding partner Cam Lewis and Michael Sullivan in writing Lewis & Sullivan on Class Actions.  Most recently, attorneys at Lewis Babcock were on the team of attorneys fighting for South Carolina citizens affected by the failed V.C. Summer nuclear project.
